“…the DEA can maintain no control over the (prescription drug) distribution chain and prevent diversion where American consumers purchase their drugs abroad. Somewhat similarly, the law that the FDA administers (the FDCA), cannot be effectuated where American consumers purchase their drugs abroad. Among the ways that the FDCA protects the American public is by requiring good manufacturing practices, proper labeling, and safe handling to prevent adulteration. Identifying a drug by its appearance and labeling is not an easy task. From a practical standpoint, inspectors cannot examine (imported) drug products and accurately determine the identity of such drugs or the degree of risk they pose to the individual who will use them.”
